Workphone Terms & Conditions
Effective Date: May 9, 2025
These Terms and Conditions (the “Agreement”) set forth the terms under which Workphone, including its affiliates, assigns and agents (“Workphone,” “we,” “us,” or “our”) provides you (“you,” “your,” “User,” or “Customer”) with access to and use of the Workphone mobile voice, messaging, and data services, applications, devices, and any other services or features we may offer (collectively, the “Service”).
1. Acceptance of Terms
You accept this Agreement by:
Activating or using the Service;
Registering for an account;
Paying for the Service; or
Using any Workphone phone number or device in conjunction with the Service.
If you do not agree to these Terms, do not use the Service.
2. Service Overview
Workphone provides mobile phone numbers and associated services (voice, text, data) primarily for startups, small businesses, and professionals who want a business line decoupled from their personal identity and devices. We offer plans that include:
Voice calling and SMS/MMS messaging within the United States
Data services for compatible devices
Optional international features depending on your plan
Number portability and business-line management tools
3. Permissible Use
Our Service is intended for lawful, typical business and personal communication. You agree not to misuse, resell, rebrand, or exploit your Workphone Service, and not to:
Use it as a substitute for high-volume call center systems or auto-dialers
Use the Service for telemarketing, robocalls, or spam messaging
Engage in excessive or abusive data or roaming usage (as defined below)
Interfere with or disrupt our network or systems
Use the Service outside the scope of personal or professional communication
4. Prohibited Use
Workphone may, at its sole discretion, suspend or terminate your account if we determine that your use is abusive, fraudulent, or excessive compared to typical usage by business customers. Prohibited activities include:
Call routing or forwarding designed to circumvent proper usage
Use as a permanent hot spot, continuous webcam streaming, or server hosting
Use in violation of any laws or third-party rights
Usage causing network congestion or service degradation for others
5. Roaming and International Use
International use may be available depending on your selected plan. Excessive roaming (including continuous use outside the United States) may result in account suspension or throttling of service.
6. Data Usage
Plans include high-speed data up to a specified limit. After reaching the data limit, speeds may be slowed or deprioritized. Continuous, unattended, or machine-based data connections are not allowed.
7. Privacy and Security
Your privacy is important to us. Our Privacy Policy governs how we collect and use personal data. You are responsible for safeguarding your account credentials and any confidential data you transmit using the Service.
8. Service Termination and Changes
We may terminate or modify your Service, without notice, for violations of this Agreement, non-payment, or if your use is deemed unreasonable, harmful, or disruptive.
9. Dispute Resolution and Arbitration
All disputes must be resolved through binding individual arbitration. By using the Service, you waive the right to a jury trial and to participate in class actions.
10. Limitations of Liability
Workphone is not liable for any indirect, incidental, or consequential damages related to your use of the Service. Our maximum liability is limited to the amount paid by you for the Service during the last 12 months.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
